(“we,” “us,” or “Company”) and our website, product pages, mobile or web applications, or other digital products that link to or reference this Policy (collectively, the “Services”) and explains what information we collect from visitors to and users of our Services (a “user,” “you,” or “your”), including information that may be used to personally identify you (“Personal Information”) and how we use it. We encourage you to read the details below. This Policy applies to any user of or visitor to our Services.
We reserve the right to change this Policy at any time. We will notify you of any changes to this Policy by posting the new Policy on or through our Services. You are advised to review this Policy periodically for any changes. Changes to this Policy are effective when they are posted on this page. You acknowledge that your continued use of our Services after we publish or send a notice about our changes to this Policy means that the collection, use, and sharing of your Personal Information is subject to the updated Policy.
This Policy does not apply to websites, apps, products, or services that we do not own or control, including the websites, apps, products, and/or services of our Customers (defined below). This means that this Policy explains only what we do with your information. Information provided by or to third parties, such as our Customers, are controlled by their respective privacy policies, which we encourage you to review for more information about their practices.
This Privacy Policy also does not apply to information collected by or provided in connection with an individual’s application for employment, current or former employment, or independent contractor arrangement with the Company.
I. INFORMATION WE COLLECT ABOUT YOU
When you use the Services or otherwise communicate with us, we collect information that you provide to us directly. For example, we collect information in the following circumstances: you (i) use or visit the Services; (ii) register for the Services or create an account or profile or accept the creation of an account or profile on your behalf (an “Account”); (iii) subscribe to newsletters; (iv) purchase a product or service on the Services; (v) request technical support; (vi) otherwise use the Service where Personal Information is required for such use and/or participation; and/or (vii) when you contact us via the Services or when you otherwise communicate with us. You can choose not to provide information that is requested of you by us; however, this may limit your ability to use or access the Services.
The information you provide to us directly may include, without limitation, the following information that may, alone or in combination with other data, constitute Personal Information:
- Individual identifiers such as your name, date of birth, account numbers with the applicable Customers, or other information we may request for identity verification purposes;
- Contact information such as your email address, mailing address, and/or phone number (“Account Information”);
- Your responses to surveys that we may ask you to complete for research purposes or to help direct Company activities;
- Details of any financial transactions you participate in on the Services, including the amount, currency, and method of payment;
- Information you provide in order to subscribe to our marketing communications;
- Information you provide when communicating with us or that you otherwise voluntarily provide to us; and/or
- Additional information as otherwise described to you at the point of collection or pursuant to your consent.
Furthermore, we or third-party analytics providers may automatically collect in and through the Services the following “Technical Data”:
- Device data: including, but not limited to, the type of device you use, data on device advertising ID’s and similar hardware qualifiers, the browser you use, and your operating system.
- Usage data: including, but not limited to, search terms entered, pages viewed, and other usage behavior identified by analytics events.
- Network and internet information: including, but not limited to, URLs, Internet Protocol (IP) addresses, bounce rates, use of spoofing, active (TCP/IP) ports, number of sessions initiated, click streams, location information and network/Wi-Fi access points.
- Information we collect via cookies and other tracking technologies while you use the Services; please see the “How Do We Use Tracking Technologies” section below for more information.
We may also collect or receive information about you from governmental records and other third-party sources, such as agencies to which you are required to make payments.
If you are using our Services as a customer (“Customer”), we may process Personal Information in the course of our business relationship with you, which may include Account Information of you or your representatives, as well as any Personal Information provided to us by you or your authorized users in connection with the Services or collected by us from your authorized users on your behalf (collectively referred to as “Customer Data”). Any Customer Data is controlled by the respective privacy policy of the Customer. For Customer users, we encourage you to review the privacy policies and/or notices of the Customer for more information about their privacy practices with respect to Customer Data.
II. HOW WE USE YOUR INFORMATION
We use the Personal Information we collect:
- To deliver and improve the Services and your overall user experience;
- To protect, investigate, and deter against fraudulent, unauthorized, or illegal activity;
- To link or combine your Personal Information with other information;
- To compare and verify information for accuracy and update our records;
- To email, text, message, or otherwise contact you with information and updates about us and the Services;
- To respond to your comments and questions and provide customer service;
- To send you information including confirmations, invoices, technical notices, updates, security alerts, and support and administrative messages;
- To analyze how you use the Services with tools such as Google Analytics, Segment, and other tools to help us understand traffic patterns and know if there are problems with the Services;
- In connection with a merger, acquisition, reorganization, sale of all or substantially all assets, or similar transaction;
- When required by law or to respond to a legal process;
- To protect our users, other individual lives, and/or the rights or property of Company;
- To maintain the security of the Services; and/or
- For any other purpose with your consent.
Notwithstanding the foregoing, in an ongoing effort to better understand our users and the Services, we might analyze your information in aggregate and/or de-identified form to operate, maintain, manage, and improve the Services. We may share this aggregated or de-identified data with our affiliates, agents, and business partners. We may also disclose aggregated or de-identified user statistics to describe the Services to current and prospective business partners and to other third parties for other lawful purposes.
III. HOW WE MAY DISCLOSE YOUR INFORMATION
In addition to the specific situations discussed elsewhere in this Policy, we disclose Personal Information in the following circumstances:
- With our corporate affiliates or subsidiaries.
- With third parties that we have partnered with, such as to jointly offer or promote any products or services. This may include your utility companies or other organizations that you use to receive services like gas and electric.
- With third-party providers that perform services to support our core business functions and internal operations, which may include database administrators, communication services, cloud computing services, advertising services, and application services providers. Some examples of these third-party service providers include, but are not limited to, Twilio, TalkDesk, and Kustomer.
- With third-party providers that perform services to support payments and transactions functionality in the Services, including, but not limited to:
- Stripe: Your Personal Information may be collected, processed and stored, such as your payment information including credit card information and/or bank account information, in accordance with Stripe’s Privacy Policy available at: https://stripe.com/privacy.
- Plaid: Your Personal Information may be transferred, stored, and processed by Plaid in accordance with the Plaid Privacy Policy available at: https://plaid.com/privacy.
- Venmo: Your Personal Information be transferred, stored, and processed by Venmo in accordance with the Venmo Privacy Policy available at: https://venmo.com/legal/us-privacy-policy/.
- To determine eligibility for additional subsidy programs, with your consent.
- To support our audit, compliance, and corporate governance functions.
- In connection with a change of ownership or control of all or part of our business (such as a merger, acquisition, reorganization, sale of assets or bankruptcy).
- If we have a good-faith belief that access, use, preservation, or disclosure of such information is reasonably necessary to detect or protect against fraud or security issues.
- If required or permitted by applicable law or regulation, including laws and regulations of the United States and other countries, or in the good faith belief that such action is necessary to: (a) comply with a legal obligation or in response to a request from law enforcement or other public authorities wherever Company may do business; (b) protect and defend the rights or property of Company; (c) act in urgent circumstances to protect the personal safety of users, customers, and contractors/employees of Company or others; or (d) enforce our Terms of Service or otherwise protect against any legal liability.

A. Sale and Sharing of Your Information
For purposes of this Policy, “sell,” “sold,” or “sale” means the disclosure of Personal Information for monetary or other valuable consideration but does not include, for example, the transfer of Personal Information as an asset that is part of a merger, bankruptcy, or other disposition of all or any portion of our business. “Sharing” means disclosing or making available Personal Information to a third party for purposes of cross-context behavioral or targeted advertising. While we do not disclose information to third parties in exchange for monetary compensation, we disclose identifiers and Internet and network activity information to third-party advertising networks and analytics providers for purposes of marketing and advertising, and to improve and measure our ad campaigns. Such disclosures may be considered “sales” or “sharing” of Personal Information under applicable laws. We do not sell or share sensitive Personal Information, nor do we sell or share Personal Information about individuals we know are under age sixteen (16).
B. Use and Disclosure of Sensitive Personal Information
We do not collect, use, or disclose sensitive Personal Information beyond the purposes authorized by the applicable law. Accordingly, we only use and disclose sensitive Personal Information as reasonably necessary and proportionate: (i) to perform our Services requested by you; (ii) to help ensure security and integrity, including to prevent, detect, and investigate security incidents; (iii) to detect, prevent and respond to malicious, fraudulent, deceptive, or illegal conduct; (iv) to verify or maintain the quality and safety of our Services; (v) for compliance with our legal obligations; (vi) with our service providers who perform services on our behalf; and (vii) for purposes other than inferring characteristics about you.
C. How Do We Use Tracking Technologies?
Some of the features on the Services may require the use of “cookies” – small text files that are stored on your device’s hard drive. You may delete and block all cookies from our Services, but parts of the Services may not work. We want to be open about our cookie use. IV. How Do We Secure Your Personal Information?
We take reasonable steps to protect your Personal Information against unauthorized access, alteration, disclosure, misuse, or destruction. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. The safety and security of your Personal Information also depends on you. If you have an account with us, you are responsible for keeping your account details (including login credentials) confidential. We urge you to take steps to keep your Personal Information safe by not disclosing your access credentials and by logging out of your account after each use. We further protect your Personal Information from potential security breaches by implementing certain technological security measures including encryption, firewalls, and secure socket layer technology. However, these measures do not guarantee that your Personal Information will not be accessed, disclosed, altered, or destroyed by breach of such firewalls and secure server software. By using the Services, you acknowledge that you understand and agree to assume these risks.
V. Data Retention
We retain your Personal Information while your account is in existence or as needed to provide the Services to you, or if you are a user from whom we have collected information on behalf of our Customer, to our Customer in accordance with instructions from our Customer. This includes data you or others provided to us and data generated or inferred from your use of the Services. Please note that we may retain information that is otherwise deleted in anonymized and aggregated form, in archived or backup copies as required pursuant to records retention obligations, or otherwise as required by law. We may retain an archived copy of your records as required by law or for legitimate business purposes. We are under no obligation to store your Personal Information indefinitely and disclaim any liability arising out of, or related to, the destruction of such information.
VI. Managing Your Privacy
- Emails
We may use some of the information we collect for email marketing purposes, including to send you promotional email communications about new Company features, products, events, or other opportunities. If you do not want to receive marketing and promotional emails from us, you may click on the “unsubscribe” link in the email to unsubscribe and opt-out of marketing email communications or see the Contact Us section below for more information. Despite your indicated email preferences, we may send you service-related communications, including notices of any updates to our Terms of Service or Privacy Policy.
- Text Messages
You may also receive informational text messages, or sign up to receive marketing text messages, from us or third-party service providers on behalf of us. By using our Services, signing up for text messaging services or otherwise opting in to receive text messages (opting in via short code or entering your phone number into an on-site collection widget), you agree that you have provided us and our third-party service providers with prior express written consent to be contacted by text message, including recurring automated promotional and personalized marketing text messages.
By providing prior express and/or prior express written consent, you agree to receive text messages under the Telephone Consumer Protection Act and related state laws, including by the use of an automatic telephone dialing system (“ATDS”) to deliver text messages to the mobile phone number which you provided to us. While you consent to receive messages sent using an ATDS (or “autodialer”), this doesn’t mean that any or all of our mobile messages are sent using an autodialer. We will use the information provided by you in connection with the text messaging services in accordance with this Privacy Policy. Your consent is not a condition of any purchase or use of our Services and your consent to be contacted as described is voluntary. You may revoke your consent and opt out to discontinue text messages at any time. If you no longer want to receive text messages from us, reply STOP (or as otherwise instructed). For text message communications, you can text back “STOP” and we will send you a text message to confirm that you have been unsubscribed.
VII. Links to Third-Party Websites
We may provide links to other websites. We have no control over these websites, and they are subject to their own terms of use and privacy policies. As such, we do not endorse and are not responsible for the availability of, or for any content, advertising, products, or other materials on or available from, these third-party websites
VIII. How We Respond to Do Not Track Signals
Your browser settings may allow you to automatically transmit a Do Not Track signal to websites and other online services you visit. We do not alter our practices when we receive a Do Not Track signal from a visitor’s browser because we do not track our visitors to provide targeted advertising. IX. Children Under Sixteen (16)
The Services are not directed to individuals who are under the age of sixteen (16) and we do not solicit nor knowingly collect Personal Information from children under the age of sixteen (16). If you believe that we have unknowingly collected any Personal Information from someone under the age of sixteen (16), please contact us immediately at legal@joinpromise.com and the information will be deleted.
X. A Note to Users Outside the United States
Our Company is based in the United States. The Services are controlled and operated by us from the United States and are not intended to subject us to the laws or jurisdiction of any state, country or territory other than that of the United States. Your Personal Information may be stored and processed in any country where we have facilities or in which we engage service providers, and by using the Services you consent to the transfer of information to countries outside of your country of residence, including the United States, which may have data protection rules that are different from those of your country. In certain circumstances, courts, law enforcement agencies, regulatory agencies, or security authorities in those other countries may be entitled to access your Personal Information.
XI. Notice of Privacy Rights for Residents of Certain U.S. States
Residents of certain U.S. states may have rights and choices regarding their Personal Information. To the extent any data protection law applies to our collection of your Personal Information, this supplemental section of our Privacy Policy outlines the individual rights you may be entitled to and how to exercise those rights.

To the extent that we may maintain inaccurate Personal Information, you may have the right to request that we correct such inaccurate Personal Information, taking into account the nature of the Personal Information and the purposes of the processing of the Personal Information.
- Right to Request Deletion. You may have the right to request that we delete certain Personal Information or records provided by or obtained about you, with certain exceptions and limitations as allowed under law.
- Right to Opt Out of the Sale and Sharing of Information. You may have the right to opt out of the processing of your Personal Information for the purpose of selling or sharing of your Personal Information for cross-context behavioral advertising. To the extent that our use of certain online tracking technologies are deemed to be a “sale” or “sharing” under certain data protection laws, you may opt out of these online tracking technologies by submitting a request to us via the information in the Contact Us section below or by broadcasting an opt-out preference signal, such as the Global Privacy Control (GPC).
- Right to Opt-Out of the use of Information for Targeted Advertising and Profiling. You may have the right to opt out of the processing of your Information for purposes of targeted advertising or profiling in furtherance of decisions that produce legal or similarly significant effects concerning you. We do not use your Information for targeted advertising or profiling purposes.
- Right to Limit Use and Disclosure of Sensitive Information. You may have the right to request that we limit the ways we use and disclose your sensitive Personal Information to uses which are necessary for us to perform the Services, or deliver the goods reasonably expected by you, or and as authorized by law. As noted elsewhere we do not use or disclose your sensitive information other than for the permitted business purposes outlined above.
- Right to Non-Discrimination. You may have a right to not be discriminated against in the Services or quality of Services you receive from us for exercising your rights. We will not discriminate against you for exercising any of your rights in this section including denying goods or Services, charging different prices or rates for goods or Services, or providing a different level of quality of goods and Services.
- Right to Disclosure of Direct Marketers. You may have a right to know the categories and names/addresses of third parties that have received Personal Information for their direct marketing purposes upon simple request, and free of charge.
- Right to Appeal. You may have the right to appeal our denial of any request you make under this section. To exercise your right to appeal, please submit an appeal request via the information in the Contact Us section below. Within the certain timeframe of receipt of your appeal, as proscribed by the applicable law we will inform you in writing of any action taken or not taken in response to your appeal, including a written explanation of the reasons for the decisions. If we deny your appeal, you may contact the Attorney General or another authority which we will help you identify.

A. Exercising Your Data Subject Rights
To exercise any of the rights described above, please submit a verifiable consumer request to us via the methods described below. The verifiable consumer request must:
- Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information, or an authorized representative; and
- Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
To help protect your privacy and maintain security, if you request access to or deletion of your Personal Information, we will take steps and may require you to provide certain information to verify your identity before granting you access to your Personal Information or complying with your request. In addition, if you ask us to provide you with specific pieces of Personal Information, we may require you to sign a declaration under penalty of perjury that you are the consumer whose Personal Information is the subject of the request.
If permitted by the applicable data protection law, you may use an authorized agent to submit requests on your behalf provided that the authorized agent is a natural person or a business entity that you have authorized to act on your behalf. If you use an authorized agent, we will require: (1) proof of written permission for the authorized agent to make requests on your behalf, and identity verification from you; or (2) proof of power of attorney pursuant under applicable law. Only you or your authorized agent may make a verifiable consumer request related to your Personal Information. We may deny a request from an authorized agent that does not submit proper verification proof. You may also make a verifiable consumer request on behalf of your minor child.
